Terms of Service

These Terms of Service ("Terms") govern your use of CastSense AI (the "Service"), operated by Anchor Velocity LLC, doing business as CastSense.ai ("CastSense," "we," "us"). By entering a tester access code and using the Service, you agree to these Terms.
1. What CastSense is
CastSense is an AI-powered fishing coach that answers questions about fishing conditions, technique, gear, and species identification, using a combination of live public data sources (tide, weather, buoy readings) and an AI language model. It is a testing and information tool, not a guarantee of results, a substitute for local regulations, or a safety system.
2. Eligibility and access
- Access requires a tester code issued by CastSense. Codes are personal to the tester they were issued to — don't share, publish, or resell your code.
- You must be 13 or older to use CastSense.
- We can deactivate any access code at any time, for any reason, including to manage the size or scope of the testing program.
- There is no charge for access during the testing phase described in these Terms. If CastSense introduces paid plans in the future, separate terms will apply and you'll be notified before any charge.
3. Acceptable use
You agree not to:
- Use CastSense for any illegal purpose, including violating fishing, wildlife, or conservation laws
- Attempt to bypass, share, or brute-force access codes
- Submit content that is unlawful, abusive, or infringes someone else's rights
- Use automated tools to scrape, overload, or reverse-engineer the Service
- Misrepresent yourself as CastSense or as speaking on its behalf
4. No fishing, safety, or legal guarantees
Read this section carefully.
- We never promise you'll catch anything. The Coach gives information and suggestions based on available data and general fishing knowledge — actual results depend on countless factors outside our control, including your skill, timing, gear, and luck.
- Species identification is not certain. The Coach's photo-based fish identification is a best-effort AI estimate, not a certified or guaranteed identification. Where regulations depend on correctly identifying a species — including protected, threatened, or catch-restricted species — you are responsible for confirming the identification yourself against official state or federal sources before keeping, releasing, or handling any catch.
- Conditions data can be wrong, delayed, or unavailable. Tide, weather, and buoy data come from third-party public sources (e.g. NOAA, NDBC, National Weather Service) and are provided as-is. Always verify current conditions through official sources before making on-water decisions, especially those involving safety.
- Regulations change and vary by location. The Coach may reference general seasonal or regulatory information, but fishing laws vary by state, water body, and season and change frequently. You are solely responsible for confirming current regulations with your state wildlife agency or equivalent authority before fishing.
- You are responsible for your own safety on the water. CastSense is not a safety device, does not replace marine safety equipment or judgment, and should never be relied on as your sole source of information for decisions that affect your safety.
5. AI-generated content
CastSense's responses are generated by an AI language model (Anthropic's Claude) combined with real-time data lookups where relevant. AI-generated answers can be incomplete, outdated, or simply incorrect. CastSense labels information as observed (pulled from a live data source) or predicted (the AI's estimate) where possible, but this labeling is a best effort, not a guarantee of accuracy.
6. Your content
You retain ownership of anything you submit to CastSense (messages, photos, Logbook entries, feedback). By submitting it, you grant us a license to use it solely to operate and improve the Service — for example, using your feedback to fix a wrong answer, or your chat history to let the Coach recall context in later messages. We do not sell your content or publish it publicly without your separate permission.
7. Intellectual property
The CastSense name, logo, and the Service's design, code, and underlying systems are the property of Anchor Velocity LLC. These Terms don't grant you any rights to our intellectual property beyond using the Service as intended.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY INFORMATION PROVIDED — INCLUDING SPECIES IDENTIFICATION, CONDITIONS DATA, OR REGULATORY INFORMATION — IS ACCURATE OR COMPLETE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANCHOR VELOCITY LLC AND ITS FOUNDERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, CATCH, INCOME, OR OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE — INCLUDING DECISIONS MADE ABOUT FISHING CONDITIONS, LOCATIONS, SPECIES IDENTIFICATION, OR REGULATORY COMPLIANCE BASED ON INFORMATION FROM THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED $50 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, WHICHEVER IS GREATER.
10. Testing phase changes
Because CastSense is in active testing, we may change, suspend, or discontinue any feature — or the entire Service — at any time without notice. We'll make reasonable efforts to give testers notice of major changes, but this isn't guaranteed during this phase.
11. Termination
You may stop using CastSense at any time by no longer using your access code. We may suspend or terminate your access at any time, with or without cause, including for violating these Terms.
12. Changes to these Terms
We may update these Terms as CastSense develops, particularly as it moves toward public launch, paid plans, or account-based access. We'll post the updated Terms here with a new "Last updated" date, and material changes will be communicated to active testers.
13. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
